1. Description of Services

Pinnacle Media Group LLC operates a marketing service that connects homeowners and property owners with independent foundation repair contractors and related home service professionals. We collect information from individuals seeking foundation repair services and refer that information to qualified contractors in the user's service area.

Pinnacle Media Group LLC does not perform foundation repair, waterproofing, structural inspections, or any other construction services. All work is performed by licensed, independent contractors who are not employees or agents of Pinnacle Media Group LLC.

2. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use our services. By using our services, you represent that you meet these requirements.

3. User Submissions

When you submit information through our website or call our telephone number, you represent that:

• All information you provide is accurate, current, and complete
• You are the homeowner, an authorized agent of the homeowner, or have permission to seek estimates for the property in question
• You are seeking foundation repair services or related information in good faith
• You consent to be contacted by Pinnacle Media Group LLC and its partner contractors as described in our Privacy Policy

4. No Guarantee of Services

We make no representations or warranties about:

• The availability of contractors in your specific service area
• The qualifications, licensing, or insurance of contractors we connect you with
• The quality, timeliness, price, or outcome of services performed by contractors
• The accuracy of estimates provided by contractors
• Any specific results from foundation repair work

You are solely responsible for evaluating contractors before engaging them, including verifying their licensing, insurance, references, and qualifications. We strongly recommend obtaining multiple estimates and checking references before authorizing any work.

5. Independent Contractor Relationship

Contractors connected to you through Pinnacle Media Group LLC are independent businesses. They are not employees, agents, partners, or representatives of Pinnacle Media Group LLC. We do not control their work, their employees, their pricing, or their business practices. Any contract for services is solely between you and the contractor.

6. Limitation of Liability

To the maximum extent permitted by law, Pinnacle Media Group LLC and its officers, members, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from or related to:

• Your use of our website or services
• The performance, conduct, or work of any contractor connected to you through our services
• Any disputes between you and a contractor
• Property damage, personal injury, or financial loss resulting from contractor services
• Errors, omissions, or inaccuracies in information provided by us or contractors
• Any other matter relating to our services

Our total liability for any claim arising from these Terms or our services shall not exceed one hundred dollars ($100.00).

7. Indemnification

You agree to indemnify, defend, and hold harmless Pinnacle Media Group LLC and its officers, members, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses, including attorneys' fees, arising from your use of our services, your breach of these Terms, or your interactions with contractors.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Pinnacle Media Group LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

9. Prohibited Uses

You may not:

• Use our services for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Submit information about persons other than yourself without authorization
• Attempt to gain unauthorized access to our systems
• Use automated tools to access our website without permission
• Interfere with the proper functioning of our website
• Use our services to harass, abuse, or harm others
• Resell or commercially exploit our services without permission

10. Compensation Disclosure

Pinnacle Media Group LLC receives compensation from contractors when we refer leads to them. This compensation may include flat fees per lead, fees per qualified call, monthly retainers, or other arrangements. Our compensation does not affect the price you pay for contractor services. Contractors set their own prices independently.

11. Marketing Communications

By providing your contact information, you consent to receive marketing communications from Pinnacle Media Group LLC and its partner contractors as described in our Privacy Policy. You may opt out at any time as described in the Privacy Policy.

12. Dispute Resolution

Informal Resolution

Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at legal@mypinnaclemediagroup.com.

Binding Arbitration

Any dispute arising from these Terms or our services that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Columbus, Ohio, or by video conference. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver

You waive any right to participate in a class action lawsuit or class-wide arbitration against Pinnacle Media Group LLC. All disputes must be brought on an individual basis.

Exception

This dispute resolution provision does not apply to small claims court actions or to claims for injunctive relief.

13. Governing Law

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws principles. Any legal action not subject to arbitration shall be brought in the state or federal courts located in Franklin County or Stark County, Ohio.

14. Modifications to Terms

We may modify these Terms at any time by posting updated Terms on our website. Material changes will be communicated when possible. Your continued use of our services after modifications constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pinnacle Media Group LLC regarding our services and supersede any prior agreements.

By opting in to receive text messages from Pinnacle Media Group LLC, you agree to the following:

1. When you opt in to the service, we may send you a message to confirm your sign-up. Message and data rates may apply. Message frequency varies. Text "HELP" for help. Text "STOP" to cancel.
2. You can cancel this service at any time. Just text "STOP" to the number you received messages from. After you send the message "STOP" to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive messages from us. If you want to join again, just sign up as you did the first time and we will start sending messages to you again.
3. If at any time you forget what keywords are supported, just text "HELP" to the number you received messages from. After you send the message "HELP" to us, we will respond with instructions on how to use our service as well as how to unsubscribe.
